GENERAL TERMS AND CONDITIONS OF USE AND PRIVACY POLICY OF THE HOTEL RIGHT OF WITHDRAWAL FROM NOVEMBER 10, 2023

ADULT ONLY: As a precautionary measure, children under 12 are not admitted to this establishment.

Following article L. 221-28 paragraph 12 of the French Consumer Code, we remind you that you do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code (since these are contracts for the provision of accommodation services that must be provided on a specific date or period). Without prejudice to the foregoing provisions and depending on the reservation methods selected by the Customer, a cancellation option for the various commercial rates available may be provided. In this case, please refer to the provisions of the cancellation policies per offer indicated in the order process under the heading "Rate Codes".

GUARANTEE/DEPOSIT: All reservations must be guaranteed to one of the following major credit cards: American Express, Master, or Visa cards.

NO-SHOW/CANCELLATION: Cancellation policy varies according to the different commercial rate offers and is indicated in the order process under the heading "Rate Codes". In case of a no-show or cancellation after the time limit indicated in the different commercial rate offers, one night will be charged by the hotel as a late cancellation fee.

ADVANCE PURCHASE/NON-REFUNDABLE RATES - Rules & Restrictions: Payments for bookings at Advance Purchase/Non-Refundable rates are not refundable and bookings may not be modified.

ADVANCE PURCHASE/NON-REFUNDABLE RATE: Full payment in advance is required. Your credit card will be charged immediately for the entire stay. Policies regarding changes to Advance Purchase/Non Refundable reservations may vary. Reservations made through certain third-party websites and travel agents may not be eligible for changes or refunds. No refunds for changes, cancellations, or non-arrival on check-in date. Charges cannot be applied to other stays, services, or merchandise. No prices or hotel availability are guaranteed until full payment is received. Even after full payment has been received, we reserve the right to cancel a reservation without notice if we become aware of or are notified of any fraud or illegal activity associated with the payment for this reservation. Early departure/cancellation: If you depart early or you cancel or fail to honor this reservation for any reason, you will not receive any credit or refund. Extensions will require a new reservation for the additional date(s), subject to availability and prevailing rates, and the existing rate shall not always apply. Other restrictions: This rate is not combinable with any other offers and promotions and is not available to groups (more than 5 rooms). This rate is non-commissionable. If you fail to arrive at the hotel on the scheduled arrival date, your reservation will be canceled and you will not receive any refund or credit. Check-in 3 PM Check-out 12 AM (noon) Breakfast is from 7 AM to 11 AM

CONTACT/ PERSONAL DATA: The telephone number collected in the form "Contact and access" and "Contact and payment details" will not be used in a commercial approach. Indeed, the information collected on these forms regarding you is the subject of a treatment intended exclusively for the treatment of your request. The duration of conservation of the data is 3 years. You have a right of access, rectification, portability, deletion of these, or a limitation of treatment. You can be opposed to the processing of your data and have the right to withdraw your consent at any time by contacting us directly. You have the right to complain to a supervisory authority if you consider that this processing of personal data does not comply with the legal requirements in force. Without prejudice to the foregoing provisions, we remind you that you have the right to register on the list of opposition to telephone solicitation.

CUSTOMER RESPONSIBILITY: The Customer is solely responsible for his choice of Services on the Site and their suitability to his needs, such that the Kube Saint Tropez cannot be held liable in this respect.

In the event of dissatisfaction with the services of Le Kube Saint Tropez and their suitability for the Customer's needs during the stay, the Customer must inform Le Kube Saint Tropez and the Customer Relations Department (kubehotel@machefert.com | +33 (0)4 94 97 20 00) no later than the day of departure. The Kube Saint Tropez may not be held liable for any dispute relating to the Services which has not been notified during the Customer's stay, which the Customer acknowledges.

CONDITION OF PROOF: In any event, and in particular in the event of litigation, Kube Saint Tropez may validly administer proof of the Customer's actions, validations, and instructions, and in particular the entry of the required banking information, the computerized registers kept in the company's computer systems, as well as the content of the Customer's messages and operations, with the help of connection logs, which the Customer acknowledges.

APPLICABLE LAW AND SETTLEMENT OF DISPUTES: The General Conditions of Use and Privacy Policy of the Establishment are governed by French law. Any Customer wishing to exercise his/her right of withdrawal following or in the event of a dispute relating to the application and/or interpretation of the Contract or the Services, the Customer undertakes to contact, as a matter of priority and during his/her stay, the Customer Relations Department of the Kube Saint Tropez concerned, whose contact details are given below:

In the event of a dispute between Le Kube Saint Tropez and the customer, both parties will endeavor to find an amicable solution.

In the event of failure to reach an amicable agreement, the customer is informed that he/she may have recourse to a conventional mediation procedure or any other alternative dispute resolution method, under the conditions set out in Title I of Book VI of the French Consumer Code. GENERAL GROUP SALES CONDITIONS FROM NOVEMBER 10, 2023

Scope

These General Terms and Conditions apply to (i) group bookings of more than five (5) rooms (group bookings) or the reservation of hotel spaces as part of the realization of events or to the reservation of hotel spaces as part of the realization of events combined with the reservation of rooms (the reservation events) hereinafter together the («Reservation»).

Any so-called Group reservation (more than five rooms) without the signature of this contract will be considered obsolete. Requests should be sent to sales@leshotelsdeparis.com

Conditions for Booking

The Customer chooses among the various services offered.

The Client is solely responsible for the choice of services and their suitability for its needs so the responsibility of the Company and the Institutions cannot be sought in this regard.

The Client returns this document with the words "good for agreement".

The Booking is confirmed by the receipt of the returned document with the mention «voucher for agreement» and the payment of a deposit of 100% of the final price.

Any confirmed and paid booking is final and cannot be reviewed or canceled.

Prices

The prices are those in force on the day of the order. They are denominated in euros and calculated excluding taxes. Consequently, they will be increased by the VAT rate.

In case of postponement of the Reservation for any reason, a tariff revision may be applied.

Payment terms

The payment of the Services is made:

• by cheque;

• by credit card;

• by transfer to the Company’s account, the details of which are attached hereto.

The advance payments are as follows:

• 100% of the price of the services is paid as a deposit at the time of delivery of this document accompanied by the mention "bon pour accord".

Late penalties

In the event of total default at maturity, the Customer shall pay the Company a late payment penalty equal to three times the legal interest rate.

The legal interest rate used is the one in force on the day of payment of the Reservation balance.

Reservation Cancellation Policy

In case of interruption or cancellation of the stay/ event, the entire Booking Price will be cashed without the right to refund or any credit or exchange for the Customer.

Force majeure

The liability of the Company may not be implemented if the non-performance or delay in the performance of any of its obligations described in these general conditions of sale results from a case of force majeure. As such, force majeure means any external, unforeseeable, and irresistible event within the meaning of Article 1148 of the Civil Code.

Court of competent jurisdiction

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.

In the absence of an amicable resolution, the dispute will be brought before the Courts of the Court of Appeal of Paris.
