INTRODUCTION TERMS & CONDITIONS MAISON HAAS HUSTINX

 

In order to make your stay as pleasant as possible, Maison Haas Hustinx requests your co-operation in observing the following as an agreement between the Guest and Maison Haas Hustinx (hereinafter called 'the Management' or ‘the Hotel’) under whose rooms are permitted to be used by the Guest:

 

1. GENERAL REMARKS

 

1.1 Tariff

The tariff is for the room only and is exclusive of any non-VAT government taxes applicable. Meals and other services are available at extra costs. To know your room tariff, please contact the Reception Desk.

 

1.2 Settlement Of Bills

Bills must be settled during checkout at our Reception Desk. Payments that have to be done before arrival can be done using online transfer or through the online booking engine MEWS Distributor. Payments at the Reception Desk can be done using debit card, credit card or cash.

 

1.3 Check-in

Please present your ID card or Passport upon Check-in, or complete the online check-in through MEWS Navigator. By law the Guest must be able present personal documents upon request for hotel records.

 

1.4 Departure

Check out time is 11:00 o’clock; please inform the Reception Desk if you wish to retain your room beyond this time. Extension will be given depending on the availability and with a maximum check out time of 13:00 o’clock. If the room is available, 20 euros will be charged. Failure of the Guest to vacate the room on expiry or period shall grant the Management the right to remove the Guest and his/her belongings from the room occupied by the Guest and apply the appropriate charges.

 

1.5 Luggage Storage 

The Guest can store luggage in the luggage room, at the Guest's sole risk as to loss or damage from any cause, Luggage may not be stored for period of more than 2 days.

 

1.6 Guest's Belongings

The Guest is particularly requested to lock the door of his/her room when going out or going to bed. For the convenience of the Guest, electronic safety lockers are provided in the room or at the Reception Desk to store any valuables.

The Management will not in any way whatsoever be responsible for any loss/or damage to the Guest's belongings or any other property from either the hotel room or the locker or any other part of the hotel for any cause whatsoever including theft or pilferage.

 

1.7 Hazardous Goods

Bringing goods and/or storing of raw or exposed cinema films, or any other article of a combustible or hazardous nature and/or prohibited goods and/or goods of objectionable nature is prohibited.

The Guest shall be solely liable and responsible to the Management, its other Guests, invitee visitors, agents and servants for all loss financial or otherwise and damage that may be caused by such articles or as a result of the Guests’ own negligence and non-observance of any instructions.

Gambling, contraband, prostitution, weapons, explosives, flammable objects, poisons, drugs, animals and pungent food are strictly prohibited on Hotel premises.

 

1.8 Guest behaviour

The Guest is responsible for their behaviour, that of their Guests or any person for whom they are responsible. The Hotel does not allow any form of partying, loud music or the presence of non-guests on the Hotel property. Failure to adhere to this may result in immediate eviction of the premises and the settlement of any costs incurred by the hotel from the guest.

It is not permitted to smoke anywhere on the premises of the hotel. The entire property of the hotel, including its outdoors areas are strict no-smoking zones. Smoking in the room, including out of the window, with the window open or outdoors incurs an immediate cleaning fee of € 100,- to be charged from the credit card of the Guest.


1.9 Damage and Loss to Property

The Guest will be held responsible for any damage or loss - both financial and physical - to the Hotel property caused by themselves, their Guests or any person for whom they are responsible. This may include but is not exclusive to: damages to the room or its furniture, disturbance and nuisance towards other guests, theft of items from the room. Charges belonging to these damages will be directly retrieved from the guest’s credit card. The hotel has the right to settle discounts that have had to be given to other guests as a response to guest misbehaviour with the credit card of the guest responsible. A specific mention needs to be made in terms of the keys provided upon check-in. Loss or misplacement of said keys will incur a payment of € 50,- by the guest.

 

1.10 Management's Rights

It is agreed that the Guest will conduct him/herself in a respectable manner and will not cause any nuisance or annoyance within the Hotel premises.

The Management has the right to request the Guest to vacate his/her room or other areas of the Hotel forthwith, without previous notice and without assigning any reason whatsoever, and the guest shall be bound to vacate when requested to do so. In case of the default the Management has the right to remove the Guests’ luggage and belongings from the room occupied by him/her.

 

1.11 Relation between the Management and the Guest

Nothing herein above shall continue or be deemed to constitute, or create any tenancy or sub-tenancy, or any other right to interact in the Hotel premises or any part of portion thereof, in favor of any Guest or resident or visitor. The Management shall always be deemed to be in full and absolute possession of the whole of the Hotel premises.

 

1.12 Government rules and regulations and application of laws

The Guest is requested to observe, abide by, confirm to and be bound by all applicable acts and laws and government rules and regulations in force at the applicable time.

 

1.13 Photographs and Videos

Using photographs and video's taken in the Hotel for commercial or a public purpose without the consent of the hotel is illegal. Guests who do so will be subject to prosecution.

 

 

2. USE OF THE MAISON HAAS HUSTINX PARKING SERVICE

Subject to this clause and upon request by the Guest, Maison Haas Hustinx (hereinafter called the ‘Hotel’) permits the Guest to use its car park space (hereinafter called the ‘Space’) as the Hotel in its sole discretion allots to the Guest for the duration of the Guest’s stay or visit to the Hotel.

 

2.1 

The Guest acknowledges that occupation of the Space by the Guest is as a bare licensee only and no relationship of landlord and tenant shall be created by the Guest’s use of the Space. The Guest also agrees that he/she shall not have exclusive possession of any Space.  The Hotel may in its absolute discretion request that the car is moved by the Guest for example in order to perform repairs and clean the Space.

 

2.2

Cars are parked at the Guest’s own risk and the Hotel cannot guarantee the security of the Guest’s car or its contents.  Guests are advised to ensure cars are locked securely, that all windows are securely closed and possessions left out of sight and that the car’s alarm is engaged.  Please contact the Hotel prior to booking to determine any height, or other, restrictions.


2.3 Charges and disposal of vehicles:

Payment is required immediately prior to check-out of the Space by the Guest or can be done using online transfer, or the MEWS Distributor environment, prior to the stay of Guest.

 

2.4 The Guest shall:

  1. Drive carefully in the Hotel car park and not obstruct entrances or exits and shall obey signs, including parking in bays to which entitled;
  2. Not make any alteration to the Space nor cause any damages to the Hotel or to any of the property of the Hotel.  Any damage caused shall be immediately reported to the Hotel and damages caused to another vehicle should be reported by the Guest to the owner of the vehicle that is damaged;
  3. Ensure his/her car has valid vehicle insurance and is roadworthy and complies with all relevant laws;
  4. Ensure that all security barriers or gates at the entrances to and exits from the car park are operated correctly and closed after use and/or to return to the Hotel any keys or control cards to any security barriers or gates to the car park when this license ends;
  5. Agree that for safety reasons no one is entitled to remain in the car park except for the purposes of parking or removing cars.



3. USE OF THE MAISON HAAS HUSTINX SANCTUM SPA

3.1 Usage of our Wellness and pool facilities 

  1. There is no lifeguard on duty at any given time, at the pool.
  2. Children under the age of 14 have to be supervised at any time in the wellness and pool facility. 
  3. The depth of the pool is 1,4 m and is by dutch law classified as a 'semi-public facility'.
  4. The spa services and/or facilities received or utilised at Haas Hustinx Spa are intended for general purposes only and are not intended to be a substitute for professional medical treatment of any condition, medical or otherwise that our guests may have. Guests of Haas hustinx Spa will fully indemnify and hold harmless Haas Hustinx Spa, its staff and suppliers from and against all liabilities, claims, expenses, damages and losses including legal fees (on an indemnity basis), arising out of or in connection with the spa treatments, services and/or facilities.

    Haas Hustinx Hotel & Spa limits its liability to a maximum of the fee to be charged by Haas Hustinx to the guest(s)

  5.  The pool is part of the Maison Haas Hustinx Hotel and its visitors hereby have red and agreed to the regulations above. 

 

4. USE OF THE MAISON HAAS HUSTINX ON-LINE RESERVATION SERVICES

 

4.1 Pre-Reservation Services

The online Pre-Reservation Services are merely informative and their purpose is solely to offer the User the possibility of consulting room availability in the hotel of their choice. WITHIN 24 HOURS USER WILL RECEIVE AN EMAIL CONFIRMING THAT THE RESERVATION HAS BEEN MADE, MEANING THAT IT WILL ONLY BE BINDING ONCE MAISON HAAS HUSTINX (hereinafter called ‘The Hotel’) HAS ACCEPTED THE RESERVATION THROUGH ITS CONFIRMATION BY EMAIL. The User must check the Reservation confirmation and notify the Hotel at once and in writing of any error.

 

4.2 On-line Reservation Services

The purpose of the On-line Reservation Services is the Reservation of a room in the Hotel. THE USE OF THESE SERVICES PRESUPPOSES FULL AND UNCONDITIONAL ACCEPTANCE AND THE VALIDITY OF EACH AND EVERY ONE OF THE GENERAL TERMS AND/OR CONDITIONS (WHICH SHALL BE DEEMED TO BE AUTOMATICALLY INCORPORATED IN THE AGREEMENT ENTERED INTO WITH THE HOTEL WITHOUT THEIR WRITTEN TRANSCRIPTION THEREIN BEING NECESSARY) INCLUDED IN THE LATEST UPDATED VERSION OF THESE GENERAL TERMS AND/OR CONDITIONS.

A) Contract Procedure: Whenever User makes use of the service, he or she will receive confirmation by email including the information that User's purchase order is in the process of being confirmed. If User is a Guest, he/she will receive an email confirming the reservation, which will act as proof of the reservation.

B) Guarantee: The reservation is confirmed and guaranteed all night long with a credit card. If the Guest then fails to show up without prior notice, the total stay will be charged (VAT and taxes included).

C) Termination of Agreement or Cancellation of a Reservation. Hereby the conditions and cancellation policy apply. The applied amounts and percentages are to be paid by the Guest;

1) Flexible rates: Can be cancelled free of charge up to 3 days prior to check-in time (3PM local time). Cancellations or modifications within 3 days prior to check-in time will be subject to full payment of the booking.

2) Non Refundable rates: Cannot be cancelled or modified free of charge once the booking is confirmed.

This clause is not valid for reservations made with special rates. In this case the respective special conditions will apply.

D) Rates per Room and Night

Rates are valid only in writing and only for the period indicated. When justifiable reasons exist, the Hotel reserves the right to amend these rates without prior notice.

The rates relative to the reservation are indicated during the reservation process. VAT/sales taxes will be applied to the rates, as well as tourism taxes according to local regulations. The aforementioned local taxes must be paid directly at the Hotel.

E) The prices shown at the time of booking include VAT (or the equivalent tax) at the tax rate applicable at that moment.

Should the tax rate change between the date of the booking and the date of the delivery of services, thus resulting in a disparity, according to tax regulations the tax rate applied to the final price will be the rate applicable at the time of the delivery of services or accrual of the tax, even in the event the former results in an increase of the final price communicated to the Guest in the booking.

 

4.3 Conduct of the user

The User undertakes to make use of the services in accordance with the Law, decency, respectability and law and order and in accordance with the provisions of these General Terms and Conditions. Consequently, the User has the obligation of refraining from using the services for illicit purposes and effects and/or contrary to what is established in these General Terms and Conditions, in a manner that may be injurious to the rights and/or interests of third parties or that may in any way harm the Hotel and/or its image or the services.

 

4.4 Modifications and suggestions

For greater efficiency and for the benefit of the Guest, the Hotel may at any time and without prior warning unilaterally modify the services it provides or the operational, technical or usage conditions of the services. Similarly, with a view to improving the service and establishing an optimum quality level (the ultimate aim of the Hotel), users are invited to suggest any modifications they may consider useful by contacting the Hotel at the following email address: info@haashustinx.nl

 

5. PROTECTION BY MAISON HAAS HUSTINX OF USERS' PERSONAL DATA

Users of the on-line Pre-Reservation and Reservation Services offered via www.haashustinx.nl are voluntarily providing data of a personal type (hereinafter Personal Data) and expressly and unconditionally agree in full to the Hotel processing them automatically and including them in a file for the purpose of being able to offer and provide services. This file is the responsibility of the Hotel.

 

THE HOTEL RESERVES TO ITSELF THE RIGHT TO ADD TO, OR ALTER OR AMEND ANY OF THE ABOVE TERMS, CONDITIONS AND RULES WHICH ARE A PART AND AN ABSTRACT OF THE LODGING ACT.
